Overpayments

We frequently receive calls about overpayment of benefits.

A Social Security overpayment can be waived if recovering the overpayment is against equity and good conscience. The overpayment may be waived if repaying the overpayment changes the persons position for worse, if the individual was living in a separate household from the overpaid person at the time of the overpayment and did not receive the overpayment, and if the individual’s financial circumstances are not material to a finding of “against equity and good conscience.”
